IMPORTANT NOTICE: By accessing, registering, listing a server, or using any service provided by Stageofgames (hereinafter "Stage Of Games™", "we", "us", "our", or "the Platform"), you (hereinafter "User", "you", "your") expressly acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you must immediately cease use of the Platform.

1. Nature of the Site — Cartelera Digital (Directory Clarification)

Stage Of Games™ operates solely and exclusively as a digital billboard and informational directory of video game servers (a "cartelera digital"). Our function is strictly limited to indexing, listing, and displaying public information or user-provided data about various active private servers.

  • Total Independence: Each server listed in our directory is a completely independent, separate, and external entity from Stage Of Games™. We do not own, operate, manage, control, or administer any of the servers listed on our Platform.
  • Content Outside Our Website: If a listed server uses images, maps, textures, mods, 3D models, registered trademarks, or any other copyright-protected resources, such use occurs on the servers and external platforms of their respective administrators. Stage Of Games™ does not host, distribute, transmit, or have technical or legal control over such files. Consequently, we have absolutely no involvement with, nor responsibility for, anything that occurs outside our website.
  • No Endorsement: The inclusion of any server in our directory does not constitute an endorsement, warranty, or guarantee by Stage Of Games™ regarding the quality, safety, legality, or reliability of that server.

2. Acceptance of Terms

By using this Platform in any manner, including but not limited to browsing, registering an account, submitting a server listing, voting, commenting, or interacting with any feature of the website, you agree to comply with and be legally bound by these Terms of Service, our Privacy Policy, and our Cookie Policy. These Terms apply to all visitors, users, server administrators, advertisers, and any other persons who access or use the Platform.

We reserve the right to modify, update, or change these Terms at any time at our sole discretion. Any modifications will become effective immediately upon posting. Your continued use of the Platform following the posting of any changes constitutes acceptance of those changes. It is your responsibility to review these Terms periodically.

3. Eligibility and Account Registration

3.1 Age Requirements

You may not create multiple accounts to manipulate votes, rankings, or visibility of servers. Each server administrator or entity is limited to one account unless expressly authorized in writing by us.

4. User-Generated Content and Server Listings

4.1 License Grant

By publishing, uploading, linking, or sharing any type of content on our Platform (including but not limited to comments, server profiles, cover images, banners, descriptions, links, or any other multimedia material), you:

  • Warrant that you are the original author of the content or possess all legal rights, licenses, and permissions necessary to publish it.
  • Warrant that your content does not infringe upon the copyright, intellectual property, privacy, honor, or any other rights of third parties.
  • Grant Stage Of Games™ a worldwide, non-exclusive, royalty-free, perpetual, and sublicensable license to host, display, store, and distribute such content solely for the proper operation and promotion of the directory.

4.2 Prohibited Content

You agree not to submit, upload, or link to any content on our Platform that:

  • Infringes any patent, trademark, trade secret, copyright, or other intellectual property right of any third party.
  • Is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable.
  • Contains malware, viruses, trojan horses, worms, or any other malicious code.
  • Promotes illegal activities, including but not limited to hacking, phishing, or distributing pirated software.
  • Impersonates any person or entity or falsely states or misrepresents your affiliation with a person or entity.
  • Violates any applicable local, national, or international law or regulation.

4.3 Right to Remove Content

We reserve the absolute right, at our sole discretion and without prior notice, to remove, modify, or disable access to any server listing, comment, or user-generated content that we deem, in our sole judgment, to violate these Terms, to be illegal, or to be otherwise objectionable.

5. Intellectual Property Policy

5.1 Our Intellectual Property

All original content available on this website, including but not limited to proprietary texts, graphics, platform logos, user interfaces, databases, programming code, and the overall visual design, is the exclusive property of Stage Of Games™ or its respective licensors. This material is protected by international copyright, patent, trademark, and intellectual property laws. The copying, reproduction, distribution, reverse engineering, or decompilation of any proprietary element of the Platform without our prior, express, and written consent is strictly prohibited.

5.2 Third-Party Intellectual Property

The trademarks, logos, game names, and service marks displayed on our Platform are the registered and unregistered trademarks of their respective owners. The listing of any game name does not imply any affiliation with or endorsement by the trademark holders. We respect the intellectual property rights of others and expect our users to do the same.

6. Disclaimer of Liability for Third-Party Content (Safe Harbor)

Stage Of Games™ operates exclusively as an intermediary information hosting service provider (safe harbor).

  • No Prior Control: We do not monitor, filter, or pre-approve each server, link, image, or text that users submit to the directory. Therefore, we are not responsible for, nor do we guarantee, the legality, accuracy, morality, or truthfulness of content generated by third parties.
  • Limitation of Liability: Legal responsibility rests solely and exclusively with the user who registered the server or generated the content. Our responsibility is strictly limited to removing or disabling access to the infringing link or profile within our website promptly upon receiving a valid notification through the established channels.
  • External Links: Links from our directory redirect to pages, downloads, or connections of external servers. Stage Of Games™ has no control over such sites, does not approve their content, and is not responsible for their privacy policies, security, legality, or technical operation. The user assumes all risk upon leaving our Platform.

7. DMCA / EU Digital Services Act (DSA) — Notice and Takedown Procedure

We respect the intellectual property rights of others and respond expeditiously to notices of alleged infringement. In accordance with the Digital Millennium Copyright Act (DMCA — USA) and the Digital Services Act (DSA — EU), if you believe that a link or content in our directory infringes your rights, you must send a formal written notification to our official channel.

For a claim to be processed and considered valid, it must be sent electronically and must contain, on a mandatory basis, the following elements:

  1. Identification of the Claimant: Your full name, postal address, telephone number, and email address.
  2. Identification of the Original Work: A detailed description of the copyrighted work that you claim has been infringed.
  3. Exact Location of the Infringing Material: The specific URL or URLs within our site where the link or profile allegedly infringing the law is located. Isolated screenshots will not be accepted unless accompanied by their corresponding location URL on our website.
  4. Reasoned Explanation: A clear explanation of the reasons why you consider the information to constitute illegal content.
  5. Good Faith Statement: An express statement indicating that you believe in good faith that the use of the material is not authorized by the copyright owner, its agent, or the law.
  6. Accuracy Statement: A signed statement (by writing your full name at the end of the message as an electronic signature) confirming that the information contained in the notification is accurate and, under penalty of perjury, that you are legitimately authorized to act on behalf of the copyright holder.

8. Protection Against Sabotage, Abuse, and False Reports (Anti-Competition)

Stage Of Games™ does not tolerate the fraudulent use of its reporting tools. It is strictly prohibited to submit false, malicious, or unfounded DMCA or DSA notifications with the purpose of sabotaging, harming the advertising, traffic, or commercial activity of other users or competing servers.

  • Penalties for Perjury and Falsity: Pursuant to Section 512(f) of the DMCA and the Digital Services Act (DSA), any person who knowingly submits a false infringement notification may be held legally liable for the resulting material damages and commercial losses (including loss of advertising revenue, legal costs, and attorney fees) suffered by the affected user or by Stage Of Games™.
  • Internal Platform Actions: If it is determined that a user, competitor, or external administrator has submitted false reports to sabotage competitors, Stage Of Games™ will take immediate action. These include, but are not limited to: permanent removal of their servers from the directory, permanent banning of their account and IP address, and initiation of pertinent legal action for defamation and unfair competition.

9. Counter-Notification and User Defense Procedure

If your server or content has been removed from our directory due to a claim that you consider erroneous or a mistaken identification, you have a period of 6 months to send us a written counter-notification to hello@stageofgames.com.

This counter-notification must include your electronic signature, identification of the material that was removed, your contact address, and a formal statement under penalty of perjury arguing that the material was removed in error, accepting submission to the corresponding judicial jurisdiction. Upon receipt of a valid counter-notification, Stage Of Games™ will notify the original claimant and may restore the link in the directory within a period of 10 to 14 business days unless the claimant files a prior judicial action.

10. Repeat Infringer Policy

We reserve the right to terminate, suspend, or permanently block, without prior notice, access to the Platform, account, or server listings of any user who is identified as a repeat infringer of third-party intellectual property rights or the legitimate use policies of the reporting system.

11. Voting and Ranking System

11.1 Fair Voting

Our voting system is designed to reflect the genuine preferences of the player community. Any attempt to manipulate votes through automated means (bots, scripts, VPN rotation), vote trading schemes, or any other fraudulent method is strictly prohibited and will result in immediate sanctions, including the removal of the server from our listings and permanent account suspension.

11.2 No Guarantee of Position

We make no guarantees regarding the ranking position of any server. Rankings are dynamic and based on algorithms that may be modified at our discretion. Premium listings are clearly marked as such and are governed by separate commercial agreements.

12. Indemnity and Legal Defense (Judicial Protection)

You agree to defend, indemnify, and hold completely harmless Stage Of Games™, as well as its owners, directors, employees, affiliates, and agents, from and against any claim, demand, lawsuit, legal action, loss, damage, liability, cost, or expense (including, without limitation, reasonable attorney fees, expert fees, and court costs) arising from or related to:

  • The content or server that you publish, advertise, link, or transmit in our directory.
  • Your violation of any copyright, intellectual property, trademark, or privacy right of a third party, whether within or outside our website.
  • Your breach of any provision of these Terms of Service.
  • Your use of or connection to any server listed on our Platform.

This indemnity obligation shall survive the termination of these Terms, the closure of your account, or the interruption of your use of the website, serving as legal shield before any court or tribunal.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, STAGE OF GAMES™, ITS OWNERS, DIRECTORS, EMPLOYEES, AFFILIATES, AND AGENTS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your access to or use of, or inability to access or use, the Platform.
  • Any conduct or content of any third party on the Platform, including any defamatory, offensive, or illegal conduct.
  • Any content obtained from the Platform.
  • Unauthorized access, use, or alteration of your transmissions or content.
  • Any connection to or interaction with any server listed on our directory.

14. Disclaimer of Warranties

THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, OR THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

16. Termination

We may terminate or suspend your account and bar access to the Platform immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of these Terms. All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

17. Governing Law and Jurisdiction

These Terms shall be governed and construed in accordance with the laws of the Federal Republic of Germany, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts located in Germany. You agree to submit to the personal jurisdiction of such courts for the purpose of litigating any such dispute.

For users located in the European Union, you may also be entitled to bring a claim before the courts of your place of habitual residence, in accordance with applicable EU consumer protection legislation.

18. Force Majeure

Stage Of Games™ shall not be liable for any failure or delay in the performance of its obligations due to causes beyond its reasonable control, including but not limited to acts of God, war, terrorism, civil unrest, governmental action, natural disasters, pandemics, epidemics, power outages, internet infrastructure failures, or any other event of force majeure.

19. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to reflect the parties' original intention as closely as possible while remaining valid, and the remaining provisions shall continue in full force and effect.

20. Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Stage Of Games™ regarding your use of the Platform, superseding any prior agreements, communications, and proposals, whether oral or written, between you and us.
